Terms of Service

1. Acceptance of Terms

By accessing and using PinsMachine ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

PinsMachine is a software-as-a-service (SaaS) platform that provides:

• AI-powered Pinterest pin generation with images, titles, and descriptions
• Bulk CSV file generation for Pinterest uploads
• Automated scheduling recommendations (15-day or 30-day spread)
• SEO optimization and keyword extraction
• Blog image fetching and AI image generation
• Optional Pinterest account connection for direct pin publishing, board management, scheduling, and analytics

3. User Accounts

To use certain features of the Service, you must:

• Be at least 18 years old
• Sign in with a valid Google account or purchase a subscription plan
• Provide accurate and complete information
• Maintain the security of your account credentials
• Not share your account access with others

4. Subscription Plans

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel at any time through your account or by contacting support. Free tier users receive 10 lifetime credits with blog and stock text overlays (no AI-generated images).

5. Usage Limits

Pin generation limits are enforced as follows:

• Free Plan: 10 credits total (lifetime limit)
• Starter Plans: 300 credits per month (resets monthly)
• Growth Plans: 1,000 credits per month (resets monthly)
• AI-generated images are available on paid plans only
• Unused credits do not roll over to the next month
• Maximum 200 URLs per bulk generation request

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Generate content that violates Pinterest's terms of service or community guidelines
• Attempt to reverse engineer or copy the Service
• Share or resell your access to the Service
• Use automated scripts to abuse the API
• Generate spam or misleading content
• Violate intellectual property rights
• Exceed your plan's monthly credit generation limits through manipulation
• Use the Service to scrape, collect, or aggregate Pinterest Data for purposes unrelated to your own pin management

7. Pinterest Integration & Compliance

PinsMachine offers an optional Pinterest integration that allows you to connect your Pinterest account for direct pin publishing, scheduling, board management, and analytics. By connecting your Pinterest account, you acknowledge and agree to the following:

7.1 Pinterest Account Connection

• Connecting your Pinterest account is entirely optional. You may use PinsMachine without connecting Pinterest — we will generate CSV files for manual upload.
• When you connect your account, you authorize PinsMachine via Pinterest's official OAuth process to act on your behalf, including reading your boards, creating and publishing pins, and retrieving your account analytics.
• You may disconnect your Pinterest account at any time from your PinsMachine dashboard, which will immediately revoke our access and delete all stored Pinterest tokens and account identifiers.

7.2 Your Responsibilities

• You are solely responsible for ensuring that the content published to your Pinterest account through PinsMachine complies with Pinterest's Community Guidelines, Acceptable Use Policy, and Terms of Service.
• You are responsible for the pins you choose to publish or schedule. PinsMachine generates content based on your inputs, but you must review and approve content before publishing.
• You acknowledge that publishing pins to Pinterest through PinsMachine is an action taken on your behalf with your explicit authorization.
• You agree not to use PinsMachine's Pinterest integration features in any way that violates Pinterest's Developer and API Terms of Service or Developer Guidelines.

7.4 Pinterest Terms Acknowledgement

Our use of Pinterest's platform services is subject to Pinterest's Developer and API Terms of Service and Developer Guidelines. By using PinsMachine's Pinterest features, you acknowledge that your continued use confirms you have reviewed and agree to Pinterest's terms as they may be updated from time to time. PinsMachine may modify or discontinue Pinterest integration features if required to maintain compliance with Pinterest's terms.

8. Intellectual Property

Your Content: You retain all rights to the URLs and content you submit. You grant us a limited license to process this content to provide the Service.

Generated Content: You own the pins, titles, descriptions, and keywords generated by the Service for your use. AI-generated images are created specifically for your use and you may use them commercially.

Our Content: The Service, including its software, algorithms, and design, is owned by PinsMachine and protected by copyright and other intellectual property laws.

9. Refund Policy

All sales are final. We do not offer refunds, credits, or prorated billing for unused pins, partial months, subscription cancellations, or plan changes. See our Refund Policy for complete details.

We encourage users to try our free plan (10 lifetime credits) before upgrading to a paid subscription.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues. We are not liable for any downtime or service interruptions. Pinterest integration features are dependent on the availability of Pinterest's API and may be subject to temporary disruptions beyond our control.

11. Payment Processing

All payments are processed securely through LemonSqueezy, our third-party payment processor. We do not store your credit card information. By purchasing a subscription, you agree to LemonSqueezy's terms of service and privacy policy.

12. Limitation of Liability

To the maximum extent permitted by law, PinsMachine shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. This includes, without limitation, any actions taken by Pinterest on your account as a result of content published through PinsMachine. Our total liability shall not exceed the amount you paid for the Service in the past 12 months.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee specific results from using the Service, including but not limited to Pinterest traffic, engagement, or sales. We do not guarantee uninterrupted access to Pinterest's API or that Pinterest integration features will always be available.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violations of these Terms or for any other reason. Upon termination, your right to use the Service will immediately cease. You may cancel your subscription at any time, and you will retain access until the end of your current billing period.

Upon termination or account deletion, all Pinterest Data associated with your account (including OAuth tokens, Pinterest username, and stored analytics) will be permanently deleted from our systems.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
