By accessing and using PinsMachine ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

PinsMachine is a software-as-a-service (SaaS) platform that provides:

• AI-powered Pinterest pin generation with images, titles, and descriptions
• Bulk CSV file generation for Pinterest uploads
• Automated scheduling recommendations (15-day or 30-day spread)
• SEO optimization and keyword extraction
• Blog image fetching and AI image generation

3. User Accounts

To use certain features of the Service, you must:

• Be at least 18 years old
• Sign in with a valid Google account or purchase a subscription plan
• Provide accurate and complete information
• Maintain the security of your account credentials
• Not share your account access with others

4. Subscription Plans

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel at any time through your account or by contacting support. Free tier users receive 5 lifetime pins with blog image fetching only (no AI-generated images).

5. Usage Limits

Pin generation limits are enforced as follows:

• Free Plan: 5 pins total (lifetime limit)
• Starter Plans: 100 pins per month (resets monthly)
• Growth Plans: 300 pins per month (resets monthly)
• AI-generated images are available on paid plans only
• Unused pins do not roll over to the next month
• Maximum 200 URLs per bulk generation request

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Generate content that violates Pinterest's terms of service
• Attempt to reverse engineer or copy the Service
• Share or resell your access to the Service
• Use automated scripts to abuse the API
• Generate spam or misleading content
• Violate intellectual property rights
• Exceed your plan's monthly pin generation limits through manipulation

7. Pinterest Compliance

You are solely responsible for ensuring your use of PinsMachine and the content you upload to Pinterest complies with Pinterest's Community Guidelines and Terms of Service. We do not control or monitor how you use the generated content. PinsMachine does not require access to your Pinterest account and does not post directly to Pinterest on your behalf.

8. Intellectual Property

Your Content: You retain all rights to the URLs and content you submit. You grant us a limited license to process this content to provide the Service.

Generated Content: You own the pins, titles, descriptions, and keywords generated by the Service for your use. AI-generated images are created specifically for your use and you may use them commercially.

Our Content: The Service, including its software, algorithms, and design, is owned by PinsMachine and protected by copyright and other intellectual property laws.

9. Refund Policy

We offer a 30-day money-back guarantee on all paid plans. If you're not satisfied within the first 30 days of your initial purchase, contact us for a full refund. See our Refund Policy for details.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues. We are not liable for any downtime or service interruptions.

11. Payment Processing

All payments are processed securely through LemonSqueezy, our third-party payment processor. We do not store your credit card information. By purchasing a subscription, you agree to LemonSqueezy's terms of service and privacy policy.

12. Refund Policy

All sales are final. We do not offer refunds, credits, or prorated billing for unused pins, partial months, subscription cancellations, or plan changes. See our Refund Policy for complete details.

We encourage users to try our free plan (5 lifetime pins) before upgrading to a paid subscription.

13. Limitation of Liability

To the maximum extent permitted by law, PinsMachine shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid for the Service in the past 12 months.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee specific results from using the Service, including but not limited to Pinterest traffic, engagement, or sales.

15. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violations of these Terms or for any other reason. Upon termination, your right to use the Service will immediately cease. You may cancel your subscription at any time, and you will retain access until the end of your current billing period.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
